Bill C-11: a broadcasting policy left to the CRTC’s discretion

Many parties have expressed concerns about the ‘exception to the exception’ that both removes from and gives control over user-generated content to the CRTC. Another problem that has not been addressed is the exceptional level of discretion that C-11 will give to the CRTC when it comes to implementing the ‘broadcasting policy for Canada’ in section 3. This brief note analyzes C-11’s broadcasting policy to explain how its implementation can be stymied simply by verb tenses.
